THE OPEN LETTER TO THE COUNCIL OF THE EUROPEAN UNION

Dear Misters Ministers,
Now the repressions against the population of Belarus are continued just the second month. These repressions have been started by the Lukashenka regime the day of the presidential elections December 19, 2010.

The regime has prepared the plan of the repressions long before the elections. Lukashenka has enlisted certain Russian circles support. At the same time he conducted negotiations with the EU ministers of foreign affairs on the “progress” of the democracy in Belarus and was agree to democratize some aspects of the electoral process. The regime has given to the candidates the opportunity to speak over the radio and in TV. But at the same time, five days before the elections the regime has started the brutal and repressive campaign forcing the electors to participate in the so-called “preliminary voting”. The electoral commissions have been composed exclusively by the representatives of the regime. The day of the voting (December 19, 2010) they have forged the results of the elections on a broad scale. In effect Lukashenka didn’t receive the necessary number of votes and didn’t win the elections.

December 15, 2010 Lukashenka has assembled the regime’s key figures in order to discuss the elections secretly: the head of the Lukashenka’s electoral group general Sheyman, the defence minister general Zhadobin, the director of the KGB general Zaitsau, the chief of the Lukashenka’s personal guard general Vtsiuryn, the minister of the internal affairs general Kuliashou, Lukashenka’s son Viktar, the chief of the Security Council general Maltsau. In fact they have acted as the staff of the provocation and the repressions against the people. They have discussed the plan of the activity of the regime’s oppressive structures on the Independence Sq. the day of the voting December 19, 2010 and the next repressive actions. They have founded the special KGB groups (every one of 5-7 officers) which should execute the arrests, interrogations, searches and the intimidation actions after December 19, 2010.

December 19 the regime has started the repressions during the voting. The officers of the regime’s special commando Almaz has attacked the presidential candidate Uladzimier Nyaklyayeu in accordance with the Lukashenka’s order. He has been savagely beaten and fainted. Then the secret services have kidnapped him and moved him from the resuscitation department of the hospital and imprisoned him in the KGB prison in Minsk. These actions were absolutely illegal and represented the attempt to kill the candidate, as the act of terrorism and the hostage-taking.

The same day of voting Lukashenka has ordered the repressive units of the police, army and KGB to act against the peaceful manifestation of the citizens. The regime has carried out the provocation directing the criminals and KGB agents to smash the windows and doors in the building of the State Administration.

The riot police has savagely beaten and mutilated hundreds of peaceful citizens which didn’t act aggressively. More than 700 persons have been imprisoned as well as some presidential candidates. Until now the advocates and members of families are not permitted to visit the persons in jail.

The regime is executing the campaign of repressions, arrests, searches and interrogations in whole Belarus. The regime intends to execute this campaign a long time. The regime has set a goal: to liquidate the national forces of the civil society, to reduce the social activity and to stop the development of the intellectual and national self-conscious groups of the population of Belarus. The regime is trying to push these persons into the state of the social degradation, to restrict their activity in the limits of the physical survival.

The police and the KGB are executing searches in the offices and private flats confiscating illegally the intellectual and information property, computers, printers, scanners, phones, video-cameras, photo-cameras, books, manuscripts, photos, information mediums (flashes, CD-DVD discs, hard discs etc.). The searches and requisitions are executed several times in the flat of the same person. Every citizen can be kidnapped on the street and escorted to the interrogation in the KGB or to the prison. After these repressions the persons are expelled from the work place or university.

The content and methods of these repressions in Belarus reflect the sense of the anti-Belarusian Lukashenka regime’s policy. This policy is directed to the gradual ethnic elimination of the Belarusian nation. The regime is creating the circumstances of the social degradation and extinction of certain social groups and using the repressions and terror in order to liquidate certain persons.

The undemocratic, anti-Belarusian policy of the Lukashenka regime has been started in 1994 when Lukashenka has seized the power supported by the Soviet KGB. The regime has burned the Belarusian school-books and in fact liquidated the national Belarusian school and education. The Belarusians have not right and possibility to learn in Belarusian language in schools and universities.

The regime has reanimated the communist policy of the russification. The protest actions against this policy are treated by the regime as the anti-state activity. The regime has liquidated completely the Belarusian TV and radio in national language, eliminated the Belarusian national social and state institutions, cultural associations, Belarusian publishing houses, Belarusian media, paralyzed the Belarusian social activity and fundamental scientific activity. These processes have caused the abrupt decline in the quality of the education and the level of the education of the population. In fact the regime has liquidated the internal and international help to the population of the contaminated regions in the Chernobyl area. The regime has eliminated the financial compensations to the persons for the break-down, reintroduced the contaminated territories to the agricultural activity. The food-production contaminated by the radionuclides is sold to the Belarusian population but the clean food is exported to Russia. The high-school graduates are forced to work in the contaminated regions of the Chernobyl area.

As a result the health of the nation (specially of the children) became worse. The Belarusains die out. Under the Lukashenka regime the population of Belarus has diminished for a half million persons (5%).

The continuation of the Soviet russification, the genocide, the elimination of the intellectual and active groups of the population from the social life represent the totally conscious policy of Lukashenka. He doesn’t cover the consciousness of this policy. For example, he has told on the so-called pre-electoral “All-Belarusian Assembly” in 2006 that the sense of his policy of the russification in Belarus is “not to permit to make something back”.
In accordance with this destructive policy the KGB director general Zhadobin had made a list of 1767 active Belarusian patriots and intellectuals which should be arrested in the first place in certain circumstances. The general had publicly commented his list.

The regime is planning to continue the actual repressions, searches, interrogations, arrests and punishment in order to persecute not less than 50 thousand persons which participated in the peaceful protests December 19, 2010. At the same time the police and the KGB are persecuting the persons from the “Zhadobin’s list” arresting the social active persons, Belarusian intellectuals which even didn’t participate in the protests or electoral campaign.

These repressive actions of the undemocratic, anti-Belarusian Lukashenka regime come within the purview of law: Art. 127 (Genocide) of the Criminal Codex of Belarus as well as come within the purview of the international definitions of genocide in relation to the policy of Aliaxandr Lukashenka.

In the circumstances of the authoritarian and absolute power of the Lukashenka regime it is practically impossible to institute legal proceedings in relation to Lukashenka in accordance with the Art. 127 (Genocide) because the assignement and dismissal of the General procurator as well as of all the chiefs of the Justice depend of Lukashenka.

The International Criminal Court cannot as well institute legal proceedings in The Haag because Belarus didn’t sign the Rome Statute and is not the member-state of the ICC. It is known that the ICC don’t is a member of the UN official structures. But nevertheless it is possible to institute legal proceedings on the proposal of the United Nations Security Council against the persons from the countries which are not the members of the ICC. There is just a precedent as well as the procedure.

In this connection, dear Misters Ministers, I big you to discuss on the Council of the European Union January 31, this year the possibility to adopt the decision on the appeal to the United Nations Security Council in order to make a proposition (a resolution) to the International Criminal Court to institute legal proceedings against the citizen of Belarus Aliaxandr Lukashenka – charge of genocide, creation of the circumstances of the degradation and extinction of certain groups of the Belarusian population and certain citizens.

I big you to pay attention to the fact that in this situation the arrest of the usurper represents the real possibility to liquidate the anti-popular regime in Belarus. If the legal proceedings will be instituted by the International Criminal Court the regime would collapse in the short run. The Belarusians will arrest him themselves and bring him to The Haag.

My proposition on the initiation of legal proceedings reflects the position of the conscious citizens of Belarus, victims of the Lukashenka regime.

These persons support the resolution of the European Parliament from January 20, 2011 on the situation in Belarus. But there are some details which I big to precise.
Lukashenka don’t have right to candidate on the presidential elections in Belarus for the third and fourth times (the 2004 referendum on the third presidential term was illegal and was not acknowledged by the international society). Because of that the appeal of the European Parliament to launch the new elections in Belarus should be specified by the statement that Lukashenka don’t have any legal right to candidate on the elections. The elections can be launched only without Lukashenka.

Lukashenka is not a legal and legally elected president. He is the usurper of the presidential position. He has falsified the elections, usurped the state power and is oppressing the Belarusian people. We big you and propose you – not to call him officially the president of Belarus.

The Lukashenka regime is carrying on the undemocratic, typical occupation anti-Belarusian policy of the creeping genocide directed against the cultural existence of the Belarusian nation.

Because of that we big you not to use the definitions “The Belarusian regime”, “the Belarusian policy”, “the Belarusian power”, “the Belarusian leader” in relation to Lukashenka as well as “the sanctions against Belarus” etc. These definitions insult the democratic Belarusians and freedom-loving persons. The Lukashenka regime, its policy, power and “leader” are anti-Belarusian, based on the KGB, anti-popular. The freedom-loving Belarusians don’t call this foreign regime a “Belarusian” one.

We hope that the Council of European Union will make effective decisions on the relations with the anti-Belarusian regime and the civil society of Belarus.
